General terms and conditions of sale (Updated: 07/17/2024)
These terms and conditions of sale are concluded on the one hand by LIVRES & MANUSCRITS, whose registered office is at 5 rue du Cambodge, 75020 Paris, registered in the Paris Trade and Companies Register under number 848 053 237 hereinafter referred to as "Librairie-Galerie Emmanuel Fradois" and on the other hand by any natural person using the www.livresetmanuscrits.com website, hereinafter referred to as "the user".
1. Application of the general terms and conditions of sale
These General Terms and Conditions of Sale are subject to Article L 441-6 of the French Commercial Code and Article L134-1 of the French Consumer Code. They are available on the website of the Librairie-Galerie Emmanuel Fradois and can be consulted freely and at any time.
The Librairie-Galerie Emmanuel Fradois may modify these general conditions at any time and without having to specify the reason, without its liability being engaged as a result.
Any changes will be posted on the site and will be effective as of the date of posting. However, only the general conditions in force at the time of conclusion of the contract shall be binding on the user.
2. Presentation of services
All items offered for sale on the www.livresetmanuscrits.com website are, unless otherwise indicated, complete and in the condition described in their description. This description is precise and allows the user to know, before the final order is placed, the physical condition and essential characteristics of the objects he wishes to acquire. The available photos cannot exhaustively define the state of the object, the user must therefore refer exclusively to the description made of it.
The website also allows users to post comments on the blog and access comments from other users.
The user also undertakes to comply with the general terms and conditions of use of the www.livresetmanuscrits.com website.
3. Orders-conclusion of contract
The user, who wishes to purchase an item, can either create an account free of charge by providing the requested information, or send us his order by post, e-mail, fax (fax) or telephone. All orders placed by telephone must be confirmed in writing.
To place an order online, he must:
- click online on the "add to basket" button corresponding to the chosen object
- to go to his basket
- enter the information necessary to create your account
- choose the payment method and the delivery method
- confirm your order after checking it and accept the General Terms and Conditions of Sale
- make the payment under the conditions provided for
The confirmation of the order implies acceptance of these general terms and conditions of sale, recognition of having full knowledge of them and waiver of the right to invoke one's own terms and conditions of purchase or other conditions.
All the data provided and the recorded confirmation will be worth proof of the transaction. The confirmation will be worth signature and acceptance of the operations carried out.
The seller will communicate by email confirmation of the recorded order.
4. Methods of payment
The items are invoiced in euros, including VAT, at the price in force at the time of the order, plus any delivery costs.
Payments can be made:
- by bank transfer: at the end of the order, the customer will receive by email the necessary bank details. The order will be validated upon receipt of the funds,
- by bank check: issued by a bank domiciled in metropolitan France and made out to LIVRES & MANUSCRITS, it should be sent to LIVRES & MANUSCRITS, 5 rue du Cambodge, 75020 PARIS, FRANCE, accompanied by the order number and the e-mail address provided when registering on the site. The order will be validated upon receipt of the cheque,
- by Visa, Mastercard, American Express, Diners Club or Discover bank card: at the end of the order process, the customer will receive a secure link by e-mail allowing him to pay for his purchase.

At the buyer's request, a paper invoice will be sent to him/her.
5. Delivery
The delivery, free of charge above 500€ of purchase, will be made within 48h to 72h by registered and insured mail, upon receipt of confirmation of payment. It is the responsibility of the customer to check the condition of the package and its contents upon delivery. Do not accept visibly deteriorated or damaged parcels (indicate it clearly on the delivery note or refuse the entire delivery). Complaints concerning the delivery beyond the 72-hour period will not be taken into account.
6. Withdrawal and return
Pursuant to Articles L 121-16 and L 121-20 of the French Consumer Code, the user has a period of 14 (fourteen) clear days to retract without penalty and without having to give a reason. However, the return costs are at the user's expense, the item must be returned in its original condition, in its original packaging (or equivalent in terms of protection) and this according to the same terms and conditions as those of the shipment (insurance, tracking). He can exercise his right of withdrawal by email via our contact form.
7. Archiving proof
The Librairie-Galerie Emmanuel Fradois will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the French Civil Code. The computerized registers of the Librairie-Galerie Emmanuel Fradois will be considered by the parties as proof of communications, orders, payments and transactions between the parties.
8. Responsibility of the user
To register, the user will need to provide a username and password in order to login to the site. This password is strictly confidential and the user is solely responsible for its confidentiality.
If the user notices any illicit use of his password, he must inform the Librairie-Galerie Emmanuel Fradois as soon as possible via its contact form so that it can take all necessary steps to put an end to this behaviour.
9. Miscellaneous
The failure of the Librairie-Galerie Emmanuel Fradois to exercise the rights granted to it pursuant to the present contract shall in no way constitute a waiver of such rights.
If one of the provisions of these General Terms and Conditions of Use is annulled by a court decision, this decision shall not be of such a nature as to call into question the validity of the other provisions which shall continue to apply.
